Aratek Biometric Co., Ltd. (hereinafter referred to as 'Aratek') respects and protects the personal privacy of all TruFace Mobile App users. In order to provide user more accurate and personalized services, Aratek will use and disclose user’s personal information in accordance with the provisions of this privacy policy. However, Aratek promises to fulfill its highly diligent and prudent obligations to user’s personal information. Except as otherwise provided in this privacy policy, Aratek will not disclose user’s personal information to external parties or provide it to third parties without user’s prior permission.
Aratek may update this privacy policy from time to time. When user agrees to the TruFace Mobile User Agreement, it is deemed that user has agreed to all the contents of this privacy policy. This privacy policy is an inseparable part of the Aratek TruFace Mobile User Agreement and has legal effect on both parties.
1.Scope of application
1) When users use the TruFace Mobile account, TruFace Mobile will obtain user’s personal information (including but not limited to user’s ID name, ID number, mobile phone number, photo, residential community name, and address);
2) When users use Aratek's network services or access Aratek's platform web pages, Aratek will automatically receive and record information from user’s browser and computer, including but not limited to user’s IP address, browser type, language used, access date and time, software and hardware feature information, and operation records of user’s requirements;
3) When users use Aratek's services, Aratek will obtain and store user’s check-in records and facial data;
4) Aratek may obtain other personal data of users from business partners through legal channels. Users understand and agree that the following information does not apply to this privacy policy;
a) Keywords information users entered when using the search service provided by TruFace Mobile;
b) Violation of laws and regulations or violation of all agreement terms related to TruFace Mobile published by Aratek and measures taken by Aratek against users.
2.Information use
1) Aratek will not provide, sell, rent, or share user’s personal information to any third party, unless it obtains user’s permission, or unless the third party and Aratek (including Aratek affiliates) provide services to user separately or jointly, and after the service is completed, it will be prohibited from accessing it, including what it could previously access.
2) Aratek also does not allow any third party to collect, edit, sell or disseminate user’s personal information through any illegal means. Any Aratek platform user engaging in such activities, once discovered, Aratek has the right to immediately terminate all agreements and services with the users.
3) For the purpose of serving users, Aratek may use user’s personal information to provide user with information that interests user or other related information, including but not limited to product and service information.
3.Information Disclosure and Sharing
Under the following circumstances, Aratek will disclose all or part of user’s personal information in accordance with user’s personal wishes or the provisions of laws, regulations, and rules:
1) Disclose to third parties with user’s prior consent;
2) To provide the products and services user requested, it is necessary to share user’s personal information with third parties;
3) Disclose to third parties or administrative and judicial agencies in accordance with relevant laws and regulations or the requirements of administrative and judicial agencies;
4) To assist in resolving related disputes and complaints, and only under the condition of sharing and disclosing user’s personal information, can the above-mentioned purposes be achieved through sharing and disclosing;
5) In the event that user violate relevant Chinese laws, regulations, rules or Aratek's relevant TruFace Mobile agreements and terms, it is necessary to disclose to third parties;
6) If users are qualified intellectual property complainant and have filed a complaint, and the complained party requests it, it shall be disclosed to the complained party in order to handle possible rights disputes between the two parties;
7) Publicly available or already legally reported by users or user’s guardian to the public;
8) Shared and disclosed for the purpose of enforcing this agreement;
9) Shared and disclosed for the purpose of maintaining social public interests, the personal and property safety of third parties, or other legitimate rights and interests;
10) Other disclosures that Aratek considers lawful and necessary according to laws, regulations, rules or website policies.
4.Information Security
Aratek accounts have security protection functions, but user still need to properly safeguard user’s personal information such as user name and password. Aratek will ensure that user’s information is not lost, misused or altered through security measures such as encrypting user passwords. However, despite the aforementioned security measures, please understand and be aware that there is no 'perfect security measures' on the information network.
If user’s personal information is improperly used or disclosed due to reasons other than Aratek, Aratek will actively fulfill its information security protection obligations, take remedial measures, prevent the expansion of information security incidents, and provide security advice to user if it knows or should know about it, but if it is still unavoidable, we shall not be held responsible for it.
5.Others
Users agree that the validity, interpretation, amendment, execution, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China. In the event of a dispute arising from this Agreement, either party shall file a lawsuit with the Nanshan District People's Court of Shenzhen, and the losing party shall bear the litigation costs, attorney fees, investigation fees, and application execution fees, including but not limited to them.
6.System Permissions
a)Camera Permission
When using the app to scan the service address QR code or clock in, user can enable camera permissions to scan the QR code or take photos. If this permission is not enabled, user will not be able to use the camera-related functions, but other functions will not be affected.
b)Read Device Location
When using the app to clock in, the app needs to obtain the device's current real-time location to determine whether the user's current location is within the clock-in range. If this permission is not enabled, user will not be able to use the clock-in function, but other functions will not be affected.
7.Account Security
All app accounts have security protection functions. Please keep user’s username and password information properly. The app will encrypt and store user passwords to ensure that user’s information is not lost, abused, or falsified. Although there are the above security measures, please note that there is no 'perfect security measure' on the information network. If users are not going to continue using TruFace Mobile and want to clear account-related information, users can uninstall TruFace Mobile. Of course, if users want to continue using this software, users can also re-register a new account in TruFace Manager.
